Terms of Service

These terms govern your use of TapSign, an electronic-signature service operated by Sawang Tech (“we”, “us”). By creating an account or signing a document through TapSign you agree to them.

1. The service

TapSign lets you upload a document, place fields on it, send it to people to fill in and sign, and receive a completed PDF with an audit trail. We may change or improve features over time; we will not remove core signing functionality from a paid plan without notice.

2. Electronic signatures

  • Signatures made through TapSign are electronic signatures in the sense of the EU eIDAS Regulation (Art. 3(10)), the UK Electronic Communications Act 2000, the US ESIGN Act and Malaysia’s Electronic Commerce Act 2006. They are not “qualified” electronic signatures.
  • Each completed document is digitally sealed with a TapSign certificate and fingerprinted (SHA-256) so later modification can be detected. The audit trail records who opened, signed or declined and when.
  • You are responsible for deciding whether an electronic signature is appropriate for a particular document. Some documents (for example wills or certain property transfers in some countries) require a different form.

3. Your account

  • You must be at least 18 and provide accurate details. Keep your password confidential; you are responsible for activity under your account.
  • A workspace belongs to the person who created it (the owner). Team members the owner adds can see and manage the workspace’s documents.
  • You may delete your account at any time from Account → Privacy & data. Deleting an owner account deletes the whole workspace permanently.

4. Your responsibilities as a sender

  • You confirm you have the right to send each document and to collect the information you ask signers for, and that you have told signers how their data will be used.
  • Where the GDPR or a similar law applies to you, you are the controller of your signers’ data and we are your processor under the Data Processing Agreement, which forms part of these terms.
  • You must not upload content that is illegal, infringes someone else’s rights, contains malware, or is used to harass or defraud.

5. Plans and payment

  • Current plans and limits are shown on the pricing page. Prices are in Malaysian Ringgit and exclude any tax that may apply.
  • Paid plans renew automatically for the period you chose until you cancel from the Billing page. Cancellation takes effect at the end of the paid period; we do not refund partial periods except where the law requires it.
  • If a payment fails we may downgrade the workspace to the free plan after notifying you. Your documents are not deleted because of a downgrade.

6. Content and intellectual property

You keep all rights to the documents you upload and the signed PDFs. You give us only the licence needed to store, render, send and deliver them as part of the service. TapSign, its software and branding belong to Sawang Tech.

7. Availability and support

We aim for the service to be available at all times but do not guarantee uninterrupted access. We may suspend the service for maintenance or security reasons and will try to give notice. Support is by email at admin@sawangtech.com.

8. Liability

To the extent permitted by law, TapSign is provided “as is” and we are not liable for indirect or consequential loss, loss of profit or loss of data. Our total liability for any claim connected to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability for fraud, death or personal injury, or anything that cannot be limited by law.

9. Termination

You may stop using TapSign at any time. We may suspend or close an account that breaches these terms, after notice where practical. On closure you can export your data for 30 days unless we had to close the account for abuse.

10. Governing law

These terms are governed by the laws of Malaysia and the courts of Kuala Lumpur have jurisdiction, without affecting the mandatory consumer-protection rights you have where you live.

11. Changes to these terms

We may update these terms. For material changes we will email account holders at least 14 days before they take effect. Continuing to use the service after that date means you accept the new terms.
